The securities regulator has clarified its stance on so-called \u201cCovered Crypto Assets\u201d and \u201cProtocol Mining\u201d involving public, permissionless PoW networks.<\/p>\n

The US Securities and Exchange Commission\u2019s Division of Corporation Finance has clarified its views on proof-of-work mining, arguing that such activities do not constitute \u201cthe offer and sale of securities\u201d as outlined in the Securities Act of 1933, so long as they meet certain criteria.<\/p>\n

In a March 20\u00a0statement, the SEC division addressed the \u201cmining of crypto assets that are intrinsically linked to the programmatic functioning of a public, permissionless network\u201d and determined that decentralized PoW networks should not be treated as securities.<\/p>\n

Although the SEC\u2019s statement did not name any specific blockchain, its views on certain PoW activities apply to permissionless networks where mining is used to participate in the consensus mechanism. The statement applies to solo miners and mining pools participating in such networks.\u00a0<\/p>\n

A pro-crypto policy tailwind<\/h2>\n

Digital asset markets, including PoW chains, are set to flourish under US President Donald Trump, who has vowed to make America the world\u2019s blockchain and crypto capital.\u00a0<\/p>\n

In addition to appointing\u00a0a pro-crypto replacement\u00a0to Gary Gensler at the SEC, the president has established the Council of Advisers on Digital Assets to advance common-sense regulations for the industry.\u00a0<\/p>\n

On March 19, the council\u2019s executive director, Bo Hines, revealed that a comprehensive stablecoin bill could\u00a0land on the president\u2019s desk\u00a0in a matter of months.\u00a0<\/p>\n

The same day, the Blockchain Association, an industry advocacy group, said a\u00a0cryptocurrency market structure bill\u00a0is expected by the summer.\u00a0<\/p>\n
